- Agreement to These Terms
This Terms of Service Agreement (“Agreement” or “Terms”) governs your access to and use of the Film Trips marketplace platform (“Platform”) and your relationship with Film Trips LLC (“Film Trips,” “we,” or “us”), a Florida limited liability company. By creating an account or completing a booking on the Platform, you (“Business” or “Client”) represent that you have read, understood, and agree to be bound by these Terms in their entirety.
These Terms incorporate by reference the Film Trips Cancellation & Refund Policy (filmtrips.co/refund-cancellation-policy) and the Film Trips Privacy Policy (filmtrips.co/privacy-policy). If you do not agree to these Terms or any incorporated policy, you may not use the Platform.
Acceptance mechanism. Acceptance of these Terms occurs when you check the “I agree to the Terms of Service” checkbox at account creation or at booking checkout. By checking that box, you confirm you have read and agreed to these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the legal authority to bind that entity, in which case “you” and “Client” refer to that entity.
- What Film Trips Is
Film Trips is a two-sided marketplace connecting local businesses with independent creators who design and lead content experiences. Film Trips LLC is a platform intermediary — not a production company, event planning agency, or employer of creators.
Creators operating on the Platform are independent contractors. They are not employees, agents, or representatives of Film Trips LLC. Film Trips provides booking infrastructure, payment processing, and platform support but does not direct, supervise, or control how creators design or conduct their experiences.
Film Trips does not operate as an escrow agent. References in these Terms to “held funds” or “pending payout” refer to Stripe’s delayed payout system, which Film Trips uses to hold booking funds pending fulfillment. Nothing in these Terms creates an escrow relationship between Film Trips and any Client.
- Eligibility & Account Registration
To use the Platform, you must:
• Be at least 18 years of age and legally authorized to enter into binding contracts.
• Provide accurate, current, and complete information when creating an account.
• Maintain the confidentiality and security of your account credentials.
Film Trips reserves the right to suspend or terminate any account that violates these Terms, provides false or misleading information, or engages in conduct inconsistent with these Terms.
- How Bookings Work
All standard private bookings on Film Trips follow this process:

Browse creator listings and submit an inquiry on a creator’s listing.

Communicate with the creator through the Film Trips platform messaging system to align on experience details. All negotiation must occur through the Film Trips platform.

The creator submits a formal quote. You may accept, reject, or request modifications. The creator may revise and resubmit until both parties reach agreement.

Upon mutual agreement, you pay 100% of the agreed booking amount upfront through Film Trips checkout, including a 5% client-side platform booking fee. Payment must be completed before any booking is confirmed.

Funds are held by Film Trips via Stripe’s delayed payout system until the experience is completed and content is delivered.

The creator marks the booking as delivered through the platform. You receive an automated notification and may accept the delivery or request changes. A single reminder is sent to you 5 calendar days after the creator marks delivery. If you take no action within 14 calendar days of the creator marking the booking delivered, funds are released to the creator automatically.

Pricing & Payment
5.1 Creator Rates & Minimum Booking
Creator rates are set independently by each creator, subject to Film Trips platform minimums. All experiences are booked at a minimum duration of 2 hours. Rates displayed on listings are the creator’s quoted rate, exclusive of the client-side booking fee described in Section 5.2.
5.2 Platform Fees
When you book through the Film Trips platform, you pay the creator’s quoted booking amount plus a 5% client-side platform booking fee collected by Film Trips at checkout.
For Ticketed Event fee structure, see Section 9.2.
5.3 Payment Processing
All payments are processed securely through Stripe. Film Trips does not store your full payment information. By completing a booking, you agree to Stripe’s Terms of Service in addition to these Terms.
5.4 Taxes
You are responsible for any applicable taxes on your purchases. Film Trips does not collect or remit sales tax on experience bookings unless required by applicable law.
- Payment Hold, Booking Completion & Auto-Release
6.1 Payment Hold
All booking funds are held by Film Trips via Stripe’s delayed payout system from the time of payment until release as described in this Section. Neither you nor the creator can access held funds during this period. Film Trips does not operate as an escrow agent and no escrow relationship is created by this arrangement.
6.2 Booking Completion — Standard Private Bookings
For standard private bookings:
• The creator marks the order as delivered through the platform transaction page upon completing content delivery.
• You receive an automated platform notification and may accept the delivered order or request changes within 14 calendar days.
• A single automated reminder is sent to you 5 calendar days after the creator marks the booking delivered.
• Held funds are released to the creator when you accept the delivered order, or automatically 14 calendar days after the creator marks the order delivered if you take no action.
6.3 Booking Completion — Ticketed Events
For Ticketed Events, funds are released to the creator at the conclusion of the booked event period. There is no separate delivery confirmation step or auto-release timer for Ticketed Events. See Section 9 for Ticketed Event terms, including the process for reporting non-delivery of Deliverables.
6.4 Content Disputes
If you believe the creator did not deliver as agreed, you must submit a formal dispute to Film Trips by emailing hello@filmtrips.co within 14 calendar days of receiving platform notification that the creator has marked the booking as delivered, or within 30 calendar days of the experience date, whichever comes first. Disputes submitted outside this window will not be reviewed and held funds will have released to the creator.
Film Trips acts as a platform moderator in disputes — not as an arbitrator or mediator. Upon receiving a dispute, Film Trips will:

Notify the creator within [2 business days] of receiving your dispute.

Collect submissions and supporting evidence from both parties.

Issue a moderation decision within [7 business days] of receiving both parties’ submissions.
Film Trips’ moderation decisions are final for amounts under $500. Disputes above this threshold may be escalated per Section 20. Possible outcomes include full release to the creator, full refund to you, or a partial resolution at Film Trips’ reasonable determination.
Film Trips’ role as platform moderator does not constitute arbitration or mediation and does not create legal liability on Film Trips’ part. Both parties retain the right to pursue other legal remedies in accordance with Section 20.
- Cancellations & Refunds
All cancellations must be requested through Film Trips and processed by a Film Trips administrator. Clients may not cancel bookings directly through the Platform. Refunds, when approved, are issued as full refunds through Stripe.
The full cancellation and refund process is governed by the Film Trips Cancellation & Refund Policy (filmtrips.co/refund-cancellation-policy), incorporated herein by reference. A summary for standard private bookings is provided below.
Force Majeure. If a booking cannot be completed due to circumstances beyond either party’s reasonable control, including acts of God, extreme weather, natural disaster, public health emergency, government-mandated closure, or venue unavailability (“Force Majeure Event”), Film Trips will work in good faith with both parties to reschedule or issue appropriate refunds from held funds. Neither party is in breach for a genuine Force Majeure Event. Force Majeure does not apply to circumstances within a party’s reasonable control, including equipment failure, scheduling conflicts, or personal illness unless resulting in hospitalization. For Ticketed Event Force Majeure, see Section 9.4.
Creator Cancellation
If a creator cancels your booking, you will receive a full refund automatically. Film Trips will notify you and assist in finding an alternative creator where possible.
For Ticketed Event cancellation terms, see Section 9.4.
- Content Ownership & Licensing
8.1 Raw Files — Not Included by Default
All raw, unedited source files captured during a Film Trip — including RAW photo files, unedited video footage, original audio recordings, and any other unprocessed captured media (collectively “Raw Files”) — remain the sole property of the creator. Raw Files are not included in any standard Film Trips booking and creators are not obligated to deliver them.
Raw File delivery is available only if:
• The creator has explicitly listed Raw File delivery as a paid add-on in their listing and you have purchased it; or
• Raw File delivery has been separately arranged as part of an Invoice Project under Section 15.
8.2 Deliverables — Exclusive License to Client
All final, edited content produced by the creator during a Film Trip — including edited photos, color-graded video, reels, and any other finished creative output delivered to you (collectively “Deliverables”) — is licensed to you as follows upon booking completion and full payment:
The creator grants you an exclusive, perpetual, royalty-free, worldwide license to use, reproduce, display, distribute, and adapt the Deliverables for any commercial or non-commercial purpose, including marketing, advertising, social media, and internal business use.
The creator retains the underlying copyright in all Deliverables but agrees that:
• The creator will not commercially license, sell, or otherwise make the same Deliverables available to any third party for commercial use.
• The creator will not use Deliverables in any way that competes with or undermines your commercial use of the content.
• The creator will not license Deliverables from your booking to any entity operating as a direct competitor in your specific market in a manner that would identifiably harm your business interests.
• Your exclusive license is personal to your organization and may not be sublicensed, sold, or assigned to any unaffiliated third party without the creator’s prior written consent. You may authorize your own employees, contractors, and agents to use Deliverables within the scope of this license, provided they do so solely for your benefit.
You may not use Deliverables to defame, misrepresent, or harm the creator or any participant who appears in the content.
8.3 Creator Portfolio Rights
Creators retain limited rights to use Deliverables for self-promotion, subject to the following:
• Standard content: Creators may use Deliverables for portfolio display and personal promotion of their Film Trips services without prior approval, provided the creator credits your business where reasonably applicable.
• Sensitive content: For experiences involving private events, children’s programming, religious gatherings, health or medical contexts, or content featuring identifiable private individuals, the creator must obtain your written approval before any public use of Deliverables.
• Private booking designation: You may request that a booking be treated as private by communicating this to the creator through the Film Trips platform messaging system. If both parties agree in writing through the platform, the creator’s public use of any Deliverables from that booking is prohibited without your subsequent written approval. Any such arrangement must be documented in on-platform communications.
8.4 Film Trips Marketing License
You acknowledge that creators independently grant Film Trips a non-exclusive, royalty-free license to display, reference, and promote Deliverables in Film Trips’ marketing materials, platform communications, case studies, and press, with creator credit. This license does not grant Film Trips the right to sell or commercially sublicense Deliverables to third parties.
- Ticketed Events
9.1 What Ticketed Events Are
A “Ticketed Event” is a Film Trip experience in which multiple members of the public may purchase individual tickets to attend through the Film Trips platform. Ticketed Events are distinct from standard private bookings in that:
• Multiple individual purchasers (“Attendees”) register and pay independently through the Film Trips platform.
• The creator, not a single client, is the primary experience host.
• All Attendees receive both access to the experience and post-experience Deliverables as described in the event listing.
9.2 Ticket Purchase & Platform Fee
When you purchase a ticket to a Ticketed Event, you pay the creator’s listed ticket price plus a 5% platform booking fee collected by Film Trips at checkout.
9.3 Content Ownership — Ticketed Events
Content ownership for Ticketed Events differs from standard private bookings. The exclusive commercial license described in Section 8.2 does not apply to Ticketed Events — because multiple Attendees receive content from the same event, exclusivity is not possible. For Ticketed Events:
• The creator retains copyright in all underlying creative work produced during the event, including master files, raw footage, and edited compositions.
• Each Attendee receives a personal, non-exclusive, perpetual, royalty-free license to use content featuring their own likeness or participation for commercial and personal purposes, including marketing, advertising, and social media.
• Attendees may not claim full ownership of, or sublicense, sell, or assign their license rights to any third party. The license is non-exclusive — the creator retains copyright and may continue to use and license the same content to other parties.
By purchasing a ticket to a Ticketed Event, you consent to being photographed and/or filmed during the event as part of the documented experience, and to the creator’s use of content featuring your likeness for portfolio and promotional purposes consistent with Section 8.3.
For Ticketed Events involving minors (under 18), the purchasing adult confirms they are a parent or legal guardian of the minor Attendee and are consenting on the minor’s behalf.
Non-delivery of Deliverables — Ticketed Events. If a creator fails to deliver Deliverables following a Ticketed Event, Attendees must report non-delivery to Film Trips at hello@filmtrips.co within 30 calendar days of the event date. Film Trips will investigate and determine an appropriate resolution, which may include a partial or full refund of the ticket price at Film Trips’ reasonable determination.
9.4 Cancellation of Ticketed Events
If a creator cancels a Ticketed Event — whether more than or within 7 calendar days before the event — Film Trips will process full refunds to all Attendees from held ticket funds.
If a Ticketed Event is rescheduled rather than cancelled:
• You will be notified of the new date within 2 business days of the reschedule decision.
• If you cannot attend the rescheduled date, you are entitled to a full refund, processed by Film Trips from held ticket funds within 5 business days of your notification to Film Trips.
• If you confirm attendance at the rescheduled date, your ticket remains valid and no refund is issued.
In the event of a Force Majeure Event (as defined in Section 7) causing cancellation of a Ticketed Event, Film Trips will work in good faith to facilitate rescheduling or process full refunds from held ticket funds.
- Stock Shoot Experiences
10.1 What Stock Shoot Experiences Are
A creator may self-designate any listing as a “Stock Shoot Experience” through the required platform disclosure field, indicating that content captured during the booking will be commercially licensed to third parties by the creator, including on stock footage and photography platforms. Creators are required to answer the stock licensing disclosure question before any listing or Ticketed Event is published on the Platform.
Before booking a Stock Shoot Experience, you should understand:
• The content ownership structure described in Section 8.2 (exclusive license to client) does not apply. Instead, you receive a personal, non-exclusive license as described in Section 10.2.
• The creator will administer their own release form, which you must review and sign before the experience begins.
• The creator retains the right to commercially license content to stock platforms, media companies, and other third-party licensees, subject to the restrictions in Section 10.4.
10.2 Content Ownership — Non-Exclusive License
For Stock Shoot Experience bookings, notwithstanding Section 8.2:
• The creator retains full ownership of all Raw Files and all underlying copyright in Deliverables.
• You receive a personal, non-exclusive, perpetual, royalty-free license to use Deliverables for your own business and personal purposes, including marketing, advertising, social media, and internal use.
• You may not sublicense, resell, or transfer your license rights to any third party.
• You do not receive the exclusive commercial license described in Section 8.2.
• Creators may not license Deliverables from your booking to any entity operating as a direct competitor in your specific market in a manner that would identifiably harm your business interests, even in a Stock Shoot context.
10.3 Creator Release Form Obligations
For Stock Shoot Experiences, the creator is solely responsible for preparing, presenting, and obtaining your signature on any release forms required to commercially license content featuring your business, premises, products, or personnel. You agree to cooperate in good faith with the creator’s release form process before the experience begins.
Film Trips has no role in preparing, reviewing, or enforcing creator release forms and assumes no liability arising from a creator’s failure to obtain adequate releases.
10.4 AI & Third-Party Licensing Restrictions
Regardless of booking type, creators are prohibited from licensing Raw Files or Deliverables to any platform or entity that uses submitted content to train AI models without obtaining prior written consent from both you and Film Trips. This restriction applies in full to Stock Shoot Experience content. See Section 11 for Film Trips’ full AI content policy.
- Artificial Intelligence — Prohibited Uses
Creators are prohibited from submitting AI-generated content as a substitute for original documentation of your experience without your prior written consent. Creators must disclose in their listing profile whether they use AI-assisted editing tools (e.g., AI upscaling, background removal). Post-processing AI tools are permitted; generative content substitution is not.
Neither you nor the creator may, without prior written consent from all relevant parties:
• Submit Deliverables or Raw Files to any AI training dataset, database, or model — including image recognition models, video AI, generative AI, or large language models.
• Upload content to any platform that uses submitted content to train AI systems, including but not limited to Adobe Firefly training, Getty AI, Shutterstock AI, or similar services.
• Use content as prompt reference, style transfer input, or fine-tuning data for any generative AI tool.
• Sell or license content to any AI data aggregator, scraping service, or synthetic media company.
If you discover that a creator has submitted AI-generated content as original documentation without your consent, contact hello@filmtrips.co immediately. Film Trips will investigate and take appropriate action, which may include a refund.
- Platform Conduct
By using the Platform, you agree to:
• Treat creators and participants with respect and professionalism at all times.
• Provide accurate and complete information about your business, community, and experience needs.
• Not request content that is illegal, deceptive, defamatory, or harmful to any individual or group.
• Not attempt to book creators discovered through Film Trips outside the Platform to avoid platform fees.
• Not use the review system to coerce, threaten, or retaliate against creators.
• Not reproduce, resell, or sublicense creator content beyond the license rights granted in Section 8.
Film Trips reserves the right to remove businesses from the Platform for violations of these standards, without liability to the removed party.
- Review System
After a booking is completed, both you and the creator may leave a review of each other through the Platform. Film Trips does not leave reviews of either party. Reviews must be honest, factual, and professional.
You agree to:
• Leave honest and factual reviews of creators.
• Not use the review system to coerce, threaten, or retaliate against creators.
• Not solicit or incentivize creators to leave positive reviews of your business.
Film Trips may remove reviews that contain harassment, defamation, or clearly fraudulent content.
- Off-Platform Bookings
Booking a creator you discovered through Film Trips outside of the Platform is a violation of these Terms and the creator’s agreement with Film Trips. This restriction applies for 12 months following your last Film Trips booking with that creator.
If a creator solicits you for an off-platform booking, please notify Film Trips immediately at hello@filmtrips.co.
Film Trips may suspend or terminate your account for violations of this Section. Fees paid for bookings completed prior to account termination are non-refundable.
- Invoice Projects
Film Trips may, at its discretion, directly invoice a Client for a custom production or content experience (“Invoice Project”). In Invoice Project arrangements:
• Your contract is with Film Trips LLC directly — the creator functions as a subcontractor to Film Trips and is not your contracting party.
• Payment terms, cancellation terms, and deliverable timelines are specified in the individual invoice or project agreement.
• All communications regarding payment, scope changes, or disputes must go through Film Trips. You may not contact the creator directly on financial matters related to an Invoice Project.
• Film Trips will issue a written determination on any cancellation request within [5 business days].
• If Film Trips is on net-30 or net-60 payment terms with you, creator payment timelines follow accordingly.
Cancellations for Invoice Projects are handled on a case-by-case basis at Film Trips’ reasonable discretion.
- Limitation of Liability, Indemnification & Warranty Disclaimer
16.1 Limitation of Liability
Film Trips is a marketplace platform and is not liable for:
• The actions, quality, safety, or conduct of any creator.
• The fitness of any creative deliverable for a specific business purpose.
• Any injury, loss, or damage occurring during or arising from an experience.
• Technical failures, payment processing errors, or platform downtime beyond Film Trips’ reasonable control.
To the maximum extent permitted by Florida law, Film Trips’ total liability to any Client shall not exceed the total amount paid to Film Trips for the specific booking in question.
16.2 Client Indemnification
You agree to indemnify, defend, and hold harmless Film Trips LLC, its members, officers, agents, and employees from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising from:
• Your use of the Platform or any Film Trips experience.
• Your breach of these Terms.
• Any misuse of Deliverables beyond the license rights granted in Section 8.
• Any third-party claim arising from your actions in connection with a Film Trip.
16.3 Film Trips Limited IP Indemnification
Film Trips agrees to indemnify, defend, and hold you harmless from any third-party claim that Film Trips’ proprietary platform technology — excluding creator-generated content, which is governed solely by the creator’s license — infringes a third party’s intellectual property rights, provided that you: (a) notify Film Trips promptly in writing of the claim; (b) give Film Trips sole control of the defense and settlement; and (c) provide reasonable cooperation in the defense.
16.4 Warranty Disclaimer
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. FILM TRIPS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.
- Intellectual Property
The Film Trips name, logo, platform design, and all original platform content are the intellectual property of Film Trips LLC. You may not use Film Trips’ branding without prior written consent, except to truthfully identify Film Trips as the booking platform used for your experience.
- Privacy
Use of the Platform is subject to our Privacy Policy at filmtrips.co/privacy-policy. Film Trips uses Stripe for payment processing — Stripe’s Privacy Policy also applies to your payment information.
- Changes to These Terms
Film Trips reserves the right to update these Terms at any time. Registered users will be notified of material changes with 30 days’ notice via email or platform notification. Continued use of the Platform after the effective date of any update constitutes acceptance of the updated Terms.
Updates to these Terms do not apply retroactively to bookings confirmed prior to the effective date of the update. The Terms in effect at the time of booking confirmation govern that booking through completion.
- Governing Law & Dispute Resolution
20.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
20.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms — including their formation, interpretation, breach, termination, or enforceability — shall be resolved exclusively through final and binding arbitration, rather than in court.
Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules, as modified by these Terms. A single arbitrator shall be appointed in accordance with AAA rules. The arbitration shall be conducted in Hillsborough County, Florida, or virtually at the arbitrator’s discretion. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Each party shall bear its own attorneys’ fees and costs in connection with any arbitration proceeding. Arbitration filing fees shall be allocated in accordance with the AAA fee schedule in effect at the time of filing.
20.3 Jury Trial & Class Action Waiver
BY AGREEING TO THESE TERMS, YOU EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY. YOU MAY NOT BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
20.4 Small Claims Carve-Out
Notwithstanding Section 20.2, either party may bring an eligible claim in small claims court in Hillsborough County, Florida, provided the claim qualifies under the jurisdictional limits of that court and is brought on an individual basis only.
20.5 Injunctive Relief Carve-Out
Notwithstanding Section 20.2, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction in Hillsborough County, Florida, where necessary to prevent irreparable harm pending the resolution of an arbitration proceeding. This includes but is not limited to Film Trips’ right to seek injunctive relief for violations of Section 14 (Off-Platform Bookings) or Section 11 (Artificial Intelligence — Prohibited Uses).
20.6 Attorneys’ Fees
Each party shall bear its own attorneys’ fees and costs in connection with any dispute arising under these Terms, whether resolved through arbitration, small claims court, or otherwise. Neither party is entitled to recover attorneys’ fees from the other except as may be awarded by an arbitrator for frivolous or bad-faith claims under applicable AAA rules.
- Confidentiality
You agree to keep confidential any non-public information shared by creators in connection with a booking, including but not limited to pricing, creative methods, proprietary experience concepts, and personal contact details. You may not use such information for any purpose other than participating in the booked Film Trip. This obligation survives the completion or termination of any booking.
This Section does not apply to information that: (a) is or becomes publicly available through no breach of this Agreement; (b) you can demonstrate was already known to you prior to disclosure; or (c) you are required to disclose by law, provided you give Film Trips prompt written notice of such requirement.
Creators are subject to a corresponding confidentiality obligation under the Creator Agreement with respect to your business information.
- Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, unenforceable, or void, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any provision does not affect the validity or enforceability of any other provision.
Without limiting the foregoing, if the class action waiver in Section 20.3 is found unenforceable in whole or in part, any class or representative claims shall proceed in court rather than in arbitration, but the remainder of the arbitration agreement in Section 20.2 shall remain in effect.
- Entire Agreement
These Terms, together with the Cancellation & Refund Policy, Privacy Policy, and any booking-specific agreements, constitute the entire agreement between you and Film Trips with respect to your use of the Platform and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the subject matter herein.
No oral modification of these Terms is binding. Film Trips’ failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. A waiver of any provision in one instance is not a waiver in any future instance.
